ESWATINI COMPETITION COMMISSION GEARS UP FOR INCREASED CARTEL ENFORCEMENT

In light of the proposed amendments to the COMESA Competition and Consumer (CCC) Protection regulations, the Eswatini Competition Commission is planning to significantly enhance its cartel enforcement efforts.

The Commission recognises that the strengthened regulations, which provide clearer guidance and address previously unregulated business practices, will require a more robust enforcement strategy.

"We will invest in capacity building of our investigation team to ensure effective enforcement and investigation of cartels. Where financial resources permit, more human resource will be engaged to fast-track investigations,” said the Commission’s Advocacy and Communications Manager Mancoba Mabuza.

He said the Commission is also implementing proactive strategies, including compliance programs and advocacy initiatives, to prevent businesses from engaging in cartel behavior.

The amendments are expected to provide clearer guidance in cases where cartel conduct may span multiple jurisdictions.

The Commission is currently amending the Competition Act, 2007, and views the COMESA regulations as a valuable source of regional best practices.

Future legislative and policy initiatives will continue to focus on strengthening competition law development.

"These amendments will assist to provide guidance where there maybe uncertainty from conflicting decisions and other evidence cartel conduct may be located in other jurisdictions and the remedies to the conduct may have impact in other jurisdictions," he said.
