SOCCER - IS this the end of the marathon case?
This comes after High Court Judge Mumcy Dlamini ruled in favour of Manzini Wanderers’ application for leave to execute her earlier judgment stopping the team from being relegated to the NFD.

The Premier League of Eswatini (PLE) is now expected to fixture Wanderers in the ongoing Premier League matches.

Manzini Wanderers are a step closer to returning to the MTN Premier League after the recent judgment by Judge Dlamini, which was released on Saturday following the submission of arguments at the High Court on Friday.

The applicant was Manzini Wanderers, with the PLE being the first respondents in the matter, while the Eswatini Football Association (EFA) were the fourth respondents.

Denver Sundowns were the second respondents, while Moneni Pirates were the third.
In her ruling, Judge Dlamini said she had taken into consideration all the submissions and that before the parties could argue the matter, the court enquired on what prejudice would be suffered by the parties if the first (PLE) and fourth (EFA) respondents were ordered to carry out orders of September 27.

“The first and fourth respondents are hereby ordered to comply with orders of September 27 with the view that in so doing, the third respondent is not adversely affected and the applicant is fixture in the present Premier League and take any other steps necessary to normalise the situation,” reads the judgment.

The judge also ruled that the second respondents Denver Sundowns be ordered to pay costs of suit.

According to the order, the PLE and EFA must comply with the judgment from last month, where Judge Dlamini ordered both to rectify the mistake made during the May 19 match between Manzini Wanderers and Denver Sundowns in letting an ineligible player, Jimoh Moses to participate in the match. 

The judge, in her ruling, mentioned that both Denver Sundowns and Moneni Pirates would not be adversely affected by the execution of the order.

The  judge said there was no basis to oppose the application by Manzini Wanderers. There was absolutely no prejudice to be suffered by respondents.

However, Wanderers demonstrated very clearly that if the application to execute was not granted, they stood to suffer irreparable harm as by the time the appeal was heard, the time for the league would have lapsed.

This now means the PLE will have to put up a 15-team league for this season in order to comply with the High Court order.
