SOCCER- AS elite league football action resumes this week, so are proceedings in the ongoing impasse between Manzini Wanderers and various respondents.
Manzini Wanderers Football Club stated in their court papers that the Premier League of Eswatini (PLE) had approached the court with unclean hands. This comes after the PLE secured a reprieve last Thursday, after presenting their case before Judge Mbutfo Mamba.
The PLE requested suspension of the contempt of court proceedings until Judge Mamba decided on their application to halt all hearings related to the ongoing dispute against Manzini Wanderers, which is currently before Judge Mumcy Dlamini.
However, Wanderers, through their lawyer Sifiso ‘Charlie’ Jele, filed papers on Friday, stating that the applicant had shown a complete disregard of national laws and court processes.
“I am advised and believe that the applicant has approached this court with unclean hands. The applicant registered and fixtured the second respondent in the Premier League despite there being a pending review application moved by the first respondent, whose outcome would relegate the second respondent to the National First Division if successful.
“The applicant further undertook to abide by any decision of the court and never opposed the review application.
When the court issued an order that the second respondent be not adversely affected, the applicant then noted the purported appeal despite their undertaking and despite the fact that they created this situation in the first place.
“I verily believe that the court cannot come to the rescue party, which has created its own misfortune.
Further argument will be made on this point during the hearing of the matter. “I am verily advised and verily believe that the applicant is enjoined respect and comply with court orders over and above compliance on its statutes and those of international bodies.
This applicant has shown a complete disregard of national laws and court proceedings,” reads the court papers.
Wanderers also pointed out that the appellant had no automatic right to appeal.
“This, therefore, means there is no appeal pending before this honourable court and notice of appeal filed by the appeal nullity.”
The matter will be heard this afternoon.
