COURT ORDERS AE TO CALL SPECIAL MEETING IN 14 DAYS

The High court has issued an order to Athletics Eswatini to show cause why the order to call a special meeting was not compelling.

The two parties have a date at the High Court to explain why an interim order issued against the federation should not be made final.

High Court Judge Sabelo Masuku issued the interim order on Monday after having heard counsel for clubs affiliated to AE and there being no appearance for the respondents, being Athletics Eswatini, Zakhele Dlamini, Thoba Mazibuko and Bongani Ntshalintshali, first to fourth respondents, respectively.

Judge Masuku ordered Zakhele and Thoba to appear before court on May 27, to show cause why an order compelling them to call or convene the Special General Meeting within 14 days should not be made final.

Also, the court called upon Dlamini and Mazibuko to show cause why they should not be ordered and compelled to convene a Special General Meeting within 14 days to fill the vacancy of the Executive Board.

Dlamini, Mazibuko and Ntshalintshali, according to the rule nisi, should also present to the AE members audited financial reports of the previous year and/or convene a meeting for the General Assembly to appoint auditors of the federation, as per Article 13.6 of the Constitution.   

Athletics Eswatini is in the middle of a crisis, where clubs are advocating for the removal of the President Zakhele Dlamini, who they claimed  unilaterally cancelled their Annual General Meeting on March 16, where clubs wanted answers on how it happened that 13 Clubs out of 17 petitioned for a Special Assembly as enshrined in the Constitution of AE.

They complained that the matter was not facilitated by the elected Executive Board, therefore, Manzini Athletics Club was the only club charged and suspended for five years without even touching base with the membership.

The commotion between the two parties led to the resignation of vice-president Sipho Vilakati together with Sanele Manana, who was responsible for gender equity and Dr Zabenguni Mkhatshwa, who was an additional member.

Lastly, it was their public relations officer Victor 'Mavikana' Dlamini, which left the president, the Secretary Mazibuko and Treasurer Bongani Ntshalintshali in the executive of the AE.
One of the club representatives Gideon Mthembu confirmed the new developments.

“This matter is now with the court as we will take everything from their response from the court,” said Mthembu.

Athletics Eswatini Secretary General Thoba Mazibuko also confirmed the court order.
 “There is an application for a court order,” he briefly said.
