The Eswatini Public Procurement Regulatory Agency (ESPPRA) has suspended Consortium Consulting (Pty) LTD T/A LCC Capital Consulting and its director, Mduduzi Nhlabatsi from participating in public procurement effective 17 June 2022.
In a notice issued by ESPPRA, this suspension comes after misconduct relating to the submission of a tender including a fraudulent document which is the labour compliance certificate.
“This circular has been issued in terms of Sections 66 read with 55 (4) of the Public Procurement Act No.7 of 2011. The Act inter alia provides for the suspension of tenderers and suppliers on the grounds specified in section 56 of the Act,” part of the circular reads.
It further states that the above-cited as per the subject must not receive any procurement contract or participate in any procurement exercise during the period of suspension.
Any existing contract entered into between the suspended tenderers and a procuring entity prior to the suspension, it was mentioned shall not be ordinarily affected by the suspension to the extent of the suspension period unless on grounds of public policy hence, Consortium Consulting (Pty) LTD T/A LCC Capital Consulting was required to deliver all ongoing contracts in accordance with the agreed terms and conditions.
