WOMAN REJOICES AFTER COURT GRANTS DIVORCE

A woman was nothing short of overjoyed when the court granted her a final decree of divorce from her estranged husband.

Chazile Magagula had instituted legal proceedings seeking a final decree of divorce from her husband. Magagula alleged that her husband of eight years deserted their home in 2016 and they have been separated ever since. 

These were allegations contained in Magagula’s affidavit she filed through her attorney, and which she led evidence of during her appearance before Magistrate Sifiso Vilakati yesterday. Magagula claimed that they contracted a civil rights marriage in community of property on March 26, 2011 and they established their home at Mpaka in the Lubombo region.

According to evidence led by Magagula in court, she said the couple bore one minor child in their marriage. She claimed that all was rosy until 2016, when her estranged husband mysteriously disappeared from their matrimonial home.

“The thing with my husband is that he is a compulsive liar, so much that I no longer believe what he says to me. He has never given me a clear reason as to why he left our home three years ago, all that he has ever told me was lies. I plead with the court to grant me a divorce from this man,” Magagula stated as her sworn evidence. When Magistrate Vilakati asked Magagula whether she has made efforts to reconcile with her husband, Magagula explained that although she had tried to involve their families to mediate on their marital issues, her husband would not show up to the meetings.

“I have tried several times to reach out to him and yet, he would either show up to meet without his family members, or not show up at all. He has never really explained why he deserted our marital home in the way that he has,” Magagula elaborated.

Magagula further informed the court that her husband had to be pulled by the nose to support their child.

“He has never supported our child and he constantly needs to be reminded to pay our child’s school fees. I would appreciate it if I were to have full custody,” she exclaimed.

After Magistrate Vilakati informed Magagula that the court was satisfied that the evidence she led before the court constituted adultery as grounds for divorce, she was then granted a final decree of divorce.

Magagula was heard exclaiming loudly, and excitedly asked the magistrate whether all the proceedings were done, much to the amusement of the court gallery.
